Posey’s Resignation Letter (January 31, 1995; accepted February 1, 1995)

Dr. David Posey resigned from the Los Angeles County Medical Examiner’s Office on January 31, 1995 (accepted February 1). No evidence shows he was rehired. He therefore offered testimony the public believed came from an official medical examiner while holding no formal position. The wrongful conviction of Don Bohana was manufactured through Posey’s actions, with full awareness by then-District Attorney Gil Garcetti.

The Polygraph of Don Bohana: 99.99% Evidence of Innocence After 25 Years Wrongfully Imprisoned


In October 1997, Donald “Don” Bohana took a polygraph about the August 1994 drowning of Dolores “Dee Dee” Jackson—ex-wife of Tito Jackson and Michael Jackson’s sister-in-law. He maintained it was an accidental drowning. The test returned a rare 99.99 NDI (No Deception Indicated) score, strongly indicating he was telling the truth. Despite this, Bohana was convicted of second-degree murder, sentenced to 15 years to life, and served about 25 years before parole. The death was originally ruled accidental (both were intoxicated; her blood-alcohol level was .23). The manner was later changed and charges filed years afterward. Forensic pathologist Dr. Michael Baden described it as consistent with accidental drowning. Bohana has always maintained his innocence. This extraordinary polygraph result is a striking anomaly and a key piece of evidence supporting his claim of actual innocence in his ongoing petition for post-conviction relief.
